May 18th, 2016 Council Minutes


The Round Lake City Council met in regular session on Wednesday, May 18th, 2016 at 6:15pm. Council Members present were: Walon Habben, Dennis Bucholz, Gary Larson and Mayor Doug Knuth. Others present were: Bruce Bentele, Derek Nelson, Eugene Cleland, Linda Koning, Diane Larson, Keith Stubbe, Scott Ellenbecker arrived at 6:45pm, Mike Sanwick arrived at 7:00pm and Council Member Court Baumgard arrived at 7:13pm.

Meeting called to order by Mayor Knuth at 6:15pm.

Additions to the agenda: Clarice Hart building permit, Keith Tordsen’s building and Abraham Algadi discussion with Doug Knuth. Motion by Habben, second by Larson to accept additions. All ayes: Carried

Motion by Bucholz, second by Habben to approve minutes from the April 13th, 2016 Nuisance Ordinance Hearings, April 13th, 2016 regular Council meeting and the April 26th, 2016 Board of Review. All ayes: Carried.

Motion by Larson, second by Bucholz to approve bills as presented – Check #19407 thru 19497 and $624.55 to Minnesota Revenue for April Withholding Tax, $3,754.09 to EFTPS for April Employer Tax, $2,175.48 to PERA for April payment, $657.00 to Minnesota Revenue for April Sales Tax for the Liquor Store, $360.00 for April Sales Tax for the Pit Stop and $3,013.00 for April Sales Tax for the City (all filed electronically). Clerk clarified a computer error and explained the utility payments for April were not entered on the receipts register prior to printing the materials for the Council. All ayes: Carried.

Lexi Wood – was not present. Resignation letter indicated her last day would be May 21st.

Bruce Bentele – Requested permission to order either crushed concrete or crushed asphalt for the end of Railroad Avenue. Council said to get the asphalt and to make sure it was crushed smaller than what is already there. Also discussed the alley between 1st and 2nd Avenue. Might have to look into some structural changes with the drainage in that area.

Derek Nelson – mentioned that next month he will submit estimates to replace the odorizer. Offered the opportunity to show the old one to the Council so they know what he’s talking about.

Elaine Walker – Thanked the Council for the time off to attend the Clerk’s Institute at the beginning of May. Valuable information and it was very much appreciated.

Sheriff’s Department – Not present. Mike Schei has been receiving complaints of a go-cart driving recklessly around town. The County doesn’t have anything that allows them to do anything about it, we need something in our ordinances that they can use when dealing with this situation. Council would like Clerk to look into surrounding towns to see what they have in their ordinances addressing go-carts, golf carts, etc. as they are being used frequently in town also.

Motion by Habben, Second by Larson to approve the building permit for Eugene & Melanie Cleland to move in a modular home to the lot in the trailer park area of 1st Avenue. All ayes: Carried.

Jerry Wood – not present. The Presbyterian Church has a contract with the City of Round Lake to maintain the sand volleyball court on their property located on Main Street across from the park. The Session would like to have that area turned back into a grass lot, the net has not been put up for a couple of years and the contract states that the City would take care of returning it to a grass lot. Motion by Larson, second by Bucholz to revert the sand volleyball court back to a grass lot. Ayes: Baumgard, Larson, Bucholz and Mayor Knuth. Habben abstained.

Mike Sanwick – Asked the Council what the City’s policy is on raising chickens within City limits. He would like to raise 4-6 chickens for the eggs and then slaughter them for eating. The Council will look into this and let him know.

Motion by Larson, second by Habben to approve the contract with Terry Pigman to continue as the City’s Assessor for 2017. All ayes: Carried.

Motion by Bucholz, second by Habben to allow the signing of the application for the Farm Winery Branch License for the Round Lake Vineyards & Winery, LLC. Since they are leasing the space from the City of Round Lake, Mayor Knuth was required to sign the application as owner of the building. Ayes: Habben, Bucholz, Baumgard and Mayor Knuth. Larson abstained.

Southwest Minnesota Broadband update – Mayor Knuth said there was talk about getting a skidder, but that has been postponed at this time. There is need for a new billing system as the company they are currently using is going out of business. Meeting Thursday, May 19, 2016.

Scott Ellenbecker – Requested the use of a cooler inside the Pit Stop to store 2 kegs for a wedding in June. Council agreed to expand the lease area to this cooler for the time June 1st – June 4th.

Motion by Bucholz, second by Baumgard to approve the purchase agreement for L & M Partners, LLC to purchase the Round Lake Pit Stop. Ayes: Bucholz, Baumgard, Habben and Mayor Knuth. Larson abstained.

Motion by Bucholz, second by Larson to approve the Ordinance regulating the possession, sale and consumption of intoxicating and 3.2 percent malt liquor within the City of Round Lake, Minnesota with the following changes. Revise 6.105 to allow for liquor in the park and ball diamond area, clarify that 6.109 (D) allows for Off-Sale license and 6.107 be changed to limit the number of Off-Sale licenses in the City of Round Lake to be one (1). All ayes: Carried.

Motion by Baumgard, second by Bucholz to approve the signing of all documents relating to the sale of the Round Lake Pit Stop to be done by Mayor Douglas Knuth and Clerk Elaine Walker. Ayes, Baumgard, Bucholz, Habben and Mayor Knuth: Carried. Larson abstained.

Motion by Habben, second by Bucholz to approve the Off-Sale Liquor License for intoxicating liquor for L & M Partners, LLC dba Round Lake Pit Stop for the period beginning June 13, 2016. All ayes: Carried.

Motion by Baumgard, second by Bucholz to allow for signing of the Cigarettes and tobacco license paperwork. All ayes: Carried.

Motion by Habben, second by Baumgard to allow for cancellation of the assumed name for the City on the Round Lake Pit Stop and the deed. All ayes: Carried.

Keith Tordsen’s building – The price to purchase the building is $72,500. Larson will check on an option to rent space rather than buy. City needs 50’ x 56’ of storage space for equipment currently stored in the Round Lake Pit Stop building.

Motion by Baumgard, second by Habben to allow hiring of contract labor to cover Lexi’s hours at the Round Lake Pit Stop until sale is final. All ayes: Carried.

Next Council meeting will be June 8th, 2016 at 6:15pm.

Motion by Habben, second by Larson to adjourn. All ayes: Carried. Meeting adjourned at 8:10pm.
